Arizona Man Sentenced in Insurance Forgery Case

A Flagstaff, Ariz., man who continued to collect insurance premiums from small business owners even though his license was revoked has been sentenced to three years in prison.
The Arizona Attorney General’s Office says 33-year-old Jeffery Ray Capshaw was sentenced for diverting premiums by forgery after reaching a plea agreement.
He also was ordered to pay a total of almost $30,000 in restitution to four victims.
Authorities say Capshaw’s license was revoked by the Arizona Department of Insurance on March 8, 2011.
But between April 10, 2011 and June 14, 2011, Capshaw continued to collect premiums from small business owners. He didn’t forward the money to insurance companies so no policies were ever issued.
When asked by one business owner for a copy of their policy, Capshaw created a forged certificate.

Insurance broker Lockton has appointed Eric Silverstein to a new role as senior vice president for its national casualty insurance practice. Silverstein will also lead the national accounts team for the Southeast U.S., based in Lockton’s Atlanta, Ga. office.
Silverstein will advise large companies about managing complex risks and how to structure casualty insurance programs.
Silverstein has more than 25 years experience in the property/ casualty insurance industry. He started his career at Liberty Mutual Insurance Co. and Wausau Insurance. He has also worked with regional and global brokers, most recently for eight years as casualty practice leader at Beecher Carlson in Atlanta.

S&P Revises Argentina’s Sovereign Debt Rating Outlook to Negative

Standard & Poor’s revised its outlook on Argentina’s sovereign debt rating to negative from stable on Monday, citing policies that include a government push to seize control of energy company YPF from Spain’s Repsol.
President Cristina Fernandez announced the YPF takeover last week, drawing swift retaliation from Spain and criticism from other key trade partners tired of her government’s unorthodox import curbs.
S&P reaffirmed Argentina’s highly speculative ‘B’ rating and said its negative outlook indicates at least a one-in-three chance of a downgrade this year or next.
“The negative outlook revision stems from policies enacted since the October 2011 presidential elections that we believe could over time increase the risk of a deterioration in the country’s macroeconomic framework, put pressure on its external liquidity, and weaken Argentina’s medium-term growth prospects,” the rating agency said in a statement.
Fernandez, a combative member of Argentina’s dominant Peronist party, won a landslide re-election in October, vowing to intensify the state-centric policies that please her supporters but irk Wall Street and some business leaders.
Earlier this year, her administration imposed tough new import restrictions in a bid to bolster the trade surplus, triggering criticism from 40 countries at the World Trade Organization last month.
S&P said Fernandez’s move to expropriate a 51-percent controlling stake in YPF was taken “abruptly and unilaterally,” and said it underscored “the weakening system of checks and balances.”
The YPF takeover bill is expected to win easy approval in Congress, which Fernandez’s allies control. The upper house is due to debate the bill on Wednesday.
Argentina, Latin America’s No. 3 economy, has yet to return to global credit markets a decade after it staged the biggest sovereign debt default in history.

California State Fund Cancels Layoffs

California’s State Compensation Insurance Fund is cancelling plans to lay off hundreds of workers, the Sacramento Bee is reporting.
State Fund President and CEO Tom Rowe issued a message to staff that stated 1,300 workers have left since the state’s largest workers’ compensation insurer announced last year it would axe up to 1,800 jobs, according to the Sacramento Bee story, which stated the number of employees remaining is small enough for State Fund to cancel the layoff.
Established in 1914 by the state legislature, State Fund is California’s largest provider of workers’ compensation insurance.
Rowe briefly addressed the attrition when State Fund released its annual report two weeks ago showing just over $1 billion dollars in net premiums earned, a drop from 2010’s figures.
It was in October of last year the entity announced a restructuring of State Fund to be implemented this year, resulting in a reduction in workforce of from 1,500 and 1,800 positions. The restructuring is expected to save the State Fund $200 million a year. Rowe had said following State Fund’s earnings release that many of those workers already took buyouts and voluntarily quit.

Solution for Disaster Recovery? House in a Box, Maybe

In one of the New Orleans neighborhoods hit hardest by flooding in Hurricane Katrina‘s aftermath, developers have built a prototype house that’s aimed at providing a quick housing solution for areas blown away by hurricanes and tornadoes or knocked down by earthquakes.
The dwelling in the Lakeview sectionof New Orleans is somewhat box-like, with a roof that slants inward and an arched structure in front that forms a covered front porch.

But style isn’t the purpose of the house that’s meant to go up quickly after disasters and then serve as permanent housing that can withstand future calamities. It’s designed to be environmentally friendly, survive outside damaged utility grids and can be shipped in pieces in a single container and assembled like an erector set.
The house is the first of its kind, but its designers believe that there could be demand for tens of thousands of them in areas around the world that need to quickly rebuild after disasters.
The arch serves as the mount for 22 solar panels and the inward-slanting roof catches rainwater, all with the goal of making the house independent of disaster-damaged electricity and water systems. Its walls are steel structural insulated panels — two sheaths of steel with a polystyrene core — best known for their use in walk-in refrigerators. The walls are erected on a system of heavy-duty tracks and supports, and tested to withstand winds of 156 miles per hour. Without wood, of course, they are quite unappealing to termites.
“This building can be put in a disaster area without infrastructure, but it is permanent and can be expanded,” said Joseph Basilice, president of OceanSafe LLC, which produced the panels for the home.
After years of disasters, they believe the market is there.
“We’re trying to make this a mass-production concept,” said Richard Dupont, estimating manager for Woodward Design + Build, the house’s construction manager. “You could sell them in onesies and twosies, but we want to sell them by the thousands.”
Basilice said the durability of the steel panels already has been proven. “After Hurricane Andrew, the only thing left standing was the walk-in coolers,” he said.
The house comprises about 1,100 square feet in a one-story living area featuring two bedrooms, two bathrooms, a great room and a kitchen. Its air conditioning system has individual room units with individual thermostats connected to a quiet outdoor compressor.
When it rains, water flows down the slanted roof into a 4-foot opening, collects in a cistern and then flows into a 6,000-gallon accumulation bladder. In New Orleans, rainwater can only be used for irrigation, although restrictions vary across the country, Basilice said.
Basilice said a filtration system could be used to make rainwater potable for almost any purpose.
“In many parts of the world, that’s how people gather their water,” said Judith Kinnard, an architecture professor at Tulane University, who, with fellow professor Tiffany Lin, designed the house. “Water is going to be an increasingly scarce resource worldwide.”
The solar panels are designed to handle the house’s routine power needs. It can also be fitted with a turbine to generate electricity in windy regions. The outside of the walls is composed of a cement fiberboard that resists moisture, Kinnard said.
About 14 weeks are required to put the house together, about the same time required for the building of a non-custom standard home, said C.J. Minor, co-owner of C&G Construction, which donated the land and served as general contractor.
Christophor Faust, managing partner a company called The Regen Group that specializes in green building techniques, said many ideas for the house started after Katrina when New Orleans-area builders were working with actor Brad Pitt’s Make It Right rebuilding project. During that period, designers submitted entries for rebuilding houses in the city.
Faust’s group lost in the finals and “after that, we decided to design a sustainable housing kit that could be shipped into a disaster area,” he said.
Faust said the group also wanted to provide employment for construction craftsmen in disaster-hit areas, something that bringing in portable trailers doesn’t do.
The house comes in a single container — transportable by truck, rail or ship — meets the toughest fire resistance codes and has walls that have been certified to withstand winds of up to 156 miles per hour, Faust said. Testing was performed in the “tornado cannon” at Texas Tech University.
There are only a few windows. Each is covered with a snap-on mesh that has been shown to repel a wooden plank hurled at 90 miles per hour, Basilice said.
Faust says flooding isn’t a problem, either, because all of the construction material is water resistant.
The demonstration house is built one foot above the level of Katrina flooding in Lakeview. But if higher water invaded, “we’d use a pressure washer to get the mud out. Then we’d invite our neighbors over to spend the next six months.”
The group has pitched the house to the Federal Emergency Management Agency and housing authorities in South Africa, Iraq, Brazil, Haiti and the Dominican Republic and is aiming to obtain a big contract later this year. In the United States, Faust said, ready-to-go housing containers could be stored at various staging points in case of disasters. Mass production would require an order of over 1,000 units, he said.
The developers aren’t ready yet to say how much the house would cost. For the demo, about 60 companies provided materials, services and labor. But the design competition for the house, which Kinnard and Lin won, required that all the materials, including the energy and water system, come in at $100,000.
“It costs more upfront, but you’ll save in operating costs for energy, maintenance and insurance. The thinking is that it will pay for itself,” Dupont said.
Would anyone just want to have the house, disaster or not?
“It’s bright and airy,” said architect Kinnard. “It has pleasant lighting and good cross currents. There are a lot of people who would appreciate such a modern design.”

Darain Atkinson founded St. Charles-based US Fidelis with his brother, Cory Atkinson. Missouri Attorney General Chris Koster says Darain Atkinson pleaded guilty to one count each of consumer fraud, insurance fraud and stealing consumer refunds.
Sentencing in St. Charles County Circuit Court is scheduled for July 16. Prosecutors are recommending a sentence of eight years.
A grand jury in St. Charles County last year indicted Darain Atkinson on 14 counts and his brother on 13 counts. Cory Atkinson faces trial Sept. 4.
US Fidelis was headquartered in Wentzville, Mo., a suburb of St. Louis. US Fidelis sold motor vehicle extended service contracts, sometimes called auto extended warranties, which are regulated by the Department of Insurance. In addition to extended service contracts, US Fidelis sold additive product contracts.
The company filed for bankruptcy in March 2010 amid accusations it used illegal telemarketing ploys and sold worthless warranties.
Lawsuits were filed in several states over alleged fraudulent activity associated with US. Fidelis.

“It’s hard to characterize this as anything other than a loss for Google, and potentially a significant one,” said Eric Goldman, director of the High Tech Law Institute at Santa Clara University School of Law. “It has given new life to a case that Google thought was dead.”
The original $1 billion lawsuit filed by Viacom in 2007 went to the heart of a major issue facing media companies, specifically how to win Internet viewers without ceding control of TV shows, movies and music.
It was seen as a test of the Digital Millennium Copyright Act, a 1998 federal law making it illegal to produce technology to circumvent anti-piracy measures, and limiting liability of online service providers for copyright infringement by users.
Writing for a two-judge panel of the 2nd Circuit, Judge Jose Cabranes concluded that “a reasonable jury could find that YouTube had actual knowledge or awareness of specific infringing activity on its website.”
A YouTube spokeswoman said in an e-mailed statement: “All that is left of the Viacom lawsuit that began as a wholesale attack on YouTube is a dispute over a tiny percentage of videos long ago removed from YouTube. Nothing in this decision impacts the way YouTube is operating.”
Viacom, in a statement, said the appeals court “delivered a definitive, common sense message to YouTube: intentionally ignoring theft is not protected by the law.”
Other plaintiffs also welcomed the decision.
“Needless to say, my clients are delighted with the reversal,” said Charles Sims, a lawyer for the Premier League, which is Britain’s top soccer league, and several other plaintiffs. “YouTube willfully blinded itself to specific infringement, and had ample ability to control infringing activity within the meaning of the copyright law.”
New York-based Viacom is controlled by Sumner Redstone and owns cable networks such as MTV and Comedy Central as well as the Paramount movie studio.
Viacom and Google are not always adversaries. On Wednesday, YouTube announced a partnership to offer online rentals of nearly 500 Paramount films, such as “The Godfather.”
Plaintiffs in the 2nd Circuit case collectively accused YouTube of improperly broadcasting about 79,000 copyrighted videos on its website between 2005 and 2008.
Viacom, which is based in New York, had contended that YouTube did nothing to stop of infringements relating to such programming as “The Daily Show with Jon Stewart,” “South Park” and “SpongeBob SquarePants.”
The 2nd Circuit found that while YouTube was entitled to a “safe harbor” provision of the copyright law, it was an open question as to whether they had “actual knowledge or red flag awareness” of specific instances of infringement.
It also said the lower court should consider whether YouTube demonstrated “willful blindness” in allowing copyrighted videos to remain on its website.
Goldman said the decision could add to the costs of online service providers, even small ones, to keep websites running.
“It is not easy for a well-meaning company to establish it is protected under the safe harbor part of the copyright law, even if its service adds significant social value,” he said. “It will make start-ups more hair-trigger on taking down news or content, for fear that failure to do so will be held against them by content providers.”
Based in Mountain View, California, Google bought YouTube in November 2006 for about $1.65 billion.
The 2nd Circuit normally hears cases in three-judge panels. The third judge on the YouTube case died while the case was pending.
In afternoon trading on the Nasdaq, Google shares fell $2.28 to $632.87, while Viacom rose 42 cents to $46.82.

Arkansas clarifies definition of small employers for medical questions

A woman of Longmont, Colorado has declined several critical Web postings, to settle a defamation lawsuit.

Dallas fire captain, Tarrant County District Attorney honored

Two men, whose work led to the arrests and convictions of dozens of arsonists in the Dallas Fort Worth, were honoured in awards ceremonies instead at the 57th annual fire and arson investigator seminar in Austin.
The awards have been by members of A Texas Advisory Committee on arson (ATAC), which is closely related to the State Fire Marshal Office and the State to finance arson hotline.
